State of Vape: In The News

While we know that flavors are under attack in several states and localities, and the likelihood of reduced access to those flavors still looming in the form of PMTA, there are other actions that various legislative and regulatory bodies are taking against the vape industry.


Recently, the FDA sent warning letters to 10 manufacturers to stop making vape products that are alleged to target minors. eJuices.co and others in the industry have always advocated for T21 laws and that no one under the age of 21 should have access to vaping products. Some of the targeted products include backpacks and sweatshirts that are designed hold and store e-cigarette products, vaping products that resemble smartwatches or children’s toys such as a portable video game system or fidget spinner and vaping liquids that imitate packaging for food products that are marketed and appeal to youth, namely candy, or feature cartoon characters (i.e. SpongeBob SquarePants).


“The public should really be outraged by these products,” said Mitch Zeller, the director of the FDA’s Center for Tobacco Products, which oversees the regulation of vape products in the United States. "The FDA is especially disturbed by some of these new products being marketed to children and teens by promoting the ease with which they can be used to conceal product use.”

While these are warning letters and usually the first step the FDA takes, keep in mind that if these manufacturers continue to produce, distribute, or sell these products, they risk FDA actions such as an injunction, seizure of products, or fines.


"These warning letters should send a clear message to all tobacco product manufacturers and retailers that the FDA is keeping a close watch on the marketplace," Zeller said. "If you're marketing or selling these products to youth, the FDA will not tolerate it." As a shop owner, if you have these products, you can sell them by a certain date (if possible), dispose of them, or even ask the manufacturer to swap them for other products that are in compliance with FDA regulations.
