What is Delta 8?
On Thursday, May 19, 2022, the Ninth Circuit ruled that products that contain the hemp-derived cannabinoid known as Delta 8 THC are completely legal under the 2018 Farm Bill. Not only was Delta 8 deemed legal but the court also determined that Delta 8 products are entitled legal to protection under federal law. This includes copyright and trademark protection.
What is Delta 8? It is one of hundreds of cannabinoids found in the THC plant. It is only present in small quantities. The Delta 8 currently on the market, at least Delta manufactured by reputable producers, is extracted from CBD. This CBD is itself manufactured by USA grown agricultural hemp.Â
Agricultural hemp is legally grown hemp which contains less than 0.3 percent Delta 9 THC by weight. Delta 9 THC, simply known as THC, is the psychoactive ingredient in cannabis and has been selectively bred out of hemp.
The 2018 Omnibus Farm Bill, also known as the agricultural improvement act, made agricultural hemp legal for cultivation and also opened the door for CBD to be sold. Delta 8 logically falls into this same category but was in legal limbo while court cases worked their way through the system.

What Does Delta 8 Do?
Unlike CBD, which is free of psychoactive properties, the Delta 8 molecule closely resembles “regular” THC. It is a relatively new product, but surveys have found that Delta 8 is often described as being a milder form of THC without paranoia and anxiety. The largest study on Delta 8 to date, conducted by researchers from the University of Buffalo and University of Michigan, described Delta 8 as the “nicer younger sibling” of Delta 9 THC.
The joint research team recently published two papers based on their survey of more than 500 participants’ who were asked to describe their experiences with Delta 8. The focus of this study was to determine how it compared to cannabis.
In the words of one participant, Delta 8 is the “nicer younger sibling” because in their view it provided all the benefits with fewer adverse reactions.

Co-authored by Jessica Kruger, PhD, a clinical assistant professor of community health and health behavior at the University of Buffalo’s School of Public Health and Health Professions, these research papers are now available in the Journal of Cannabis Research was co.
According to Jessica Kruger:Â
“Because this is one of the first studies of its kind on delta-8-THC and so many states have changed their legislation, we wanted to really explore what people felt as they were using it compared to delta-9-THC. We found that people who are utilizing delta-8-THC feel fewer negative side effects, and they are using it in modalities that are safer, like vaping or edibles or using topically.”
This study was released at a time when states many states are both legalizing cannabis for recreational and medicinal use, while inexplicably barring Delta 8. Six of the states that have banned Delta 8 allow recreational use of cannabis, 10 allow medical use and three have decriminalized recreational use.
Daniel J. Krueger, University of Michigan co-author found, “It’s paradoxical that different states and municipalities are opening up to delta-9, it’s becoming more available and increasingly legalized, and yet they’re putting the brakes on delta-8, even though it seems to have a better profile in terms of its effects. It’s almost like the opposite of what you would do if you were informed of the evidence."
